Former Barcelona and Brazil star Dani Alves will remain in prison pending his trial for the alleged rape of a woman because he was considered a high-flyer, the decision of the District Court of Barcelona today Two.
“There is a high degree of escape, linked on the one hand to the maximum sentence that can be given because of the current case, the serious evidence of the crimes against him and the many financial things that allow him to leave Spain at any time,” the court said in a statement.
The court believed that carrying the passport of the 39-year-old does not prevent him from leaving Spain “by air or sea or land without documents.”
If he returns to Brazil, his country, the court believes that he will not be extradited to Spain because the South American country does not usually bring its citizens.
The prosecutor’s office opposed his release.
On January 2, a young woman alleged that Alves raped her in the bathroom of a nightclub in Barcelona at the end of December.
The actor, who initially denied knowing her, changed his story several times but later said they had a consensual relationship, according to sources close to the matter.
Alves is on trial for the crime of sexual assault – which in Spanish criminal law includes rape.
On January 20, the investigating judge ordered that he be held in jail without bail, ignoring, among other things, the contradictions in his initial statements and the high risk of escape.
Alves was sacked by his club Pumas UNAM in Mexico after his arrest.
In a very successful career, Alves made 408 appearances for Barcelona, with 391 of them coming in his first spell from 2008-2016.
In that first time, he won six La Liga titles, three Champions League crowns and four Copa del Rey trophies.
At the end of the World Cup in Qatar last year, he became the oldest player to represent Brazil in the football tournament.
